How is fault decided in Ontario?

By the Fault Determination Rules, a regulation under the Insurance Act. An adjuster matches the accident to the situations set out in the rules and assigns fault as a percentage to each driver. That assessment is made independently of whether police attended, whether a charge was laid, and whether a charge was later withdrawn.

Fault is not all-or-nothing. A driver can be found partly responsible, and a partial finding still attaches to the insurance record.

Because the rules work from the shape of the collision rather than from a judgement about carelessness, a driver who feels blameless can still be assigned fault: the rules ask what kind of accident it was, not who behaved worse.

A claim made under a coverage where no fault is assigned, such as a comprehensive claim, is recorded differently from an at-fault collision claim.
